Terms of Service

Welcome to Velvet Lobby ("Platform," "we," "us," or "our"). By accessing or using this website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you and Velvet Lobby.

1. Eligibility

You must be at least 18 years of age to access or use the Platform. By using the Platform, you represent and warrant that you are 18 years of age or older, that you have the legal capacity to enter into a binding agreement, and that your use of the Platform does not violate any applicable law or regulation in your jurisdiction. If you are accessing the Platform on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

The Platform contains adult content intended for mature audiences only. Access from jurisdictions where such content is prohibited by law is strictly forbidden. You are solely responsible for determining whether your access to and use of the Platform is lawful in your jurisdiction.

2. Nature of the Platform

Velvet Lobby is an online directory and communications platform that enables independent adult service providers ("Providers") to advertise their services and communicate with prospective clients ("Gentlemen" or "Members"). Velvet Lobby does not employ Providers, does not arrange, facilitate, or participate in any in-person meetings, and does not provide, broker, or endorse any services offered by Providers. All transactions, arrangements, and interactions between Providers and Members occur entirely outside of and independent from the Platform.

Velvet Lobby is a passive conduit and hosting service within the meaning of applicable law, including Section 230 of the Communications Decency Act (47 U.S.C. § 230). We are not responsible for content posted by users.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Provider Accounts

Providers who create profiles on the Platform represent and warrant that: (a) they are at least 18 years of age; (b) all content they upload, including photographs and text, depicts only individuals who are at least 18 years of age; (c) they have obtained all necessary consents from individuals depicted in their content; (d) their profile and all content complies with these Terms and all applicable laws; and (e) they have submitted valid age and identity verification as required by the Platform.

Providers acknowledge that their profiles are publicly visible and that the Platform does not guarantee any particular level of visibility, inquiries, or business. Provider subscription fees are non-refundable except as required by applicable law.

5. Member Accounts

Members acknowledge that the Platform is a directory service only. Messaging features are available exclusively to Members with an active paid membership (Velvet Lobby Premier or Velvet Lobby Elite). Free accounts may browse the directory but may not initiate or receive direct messages. Membership fees are non-refundable except as required by applicable law.

6. Prohibited Content and Conduct

You agree that you will not use the Platform to:

• Post, upload, or transmit any content depicting minors in a sexual or suggestive manner, or any content that constitutes child sexual abuse material (CSAM). Such content will be immediately reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement.
• Post content depicting full nudity, explicit sexual acts, or graphic sexual content.
• Solicit, advertise, or facilitate prostitution, sex trafficking, or any other illegal sexual services.
• Harass, threaten, stalk, or abuse any other user.
• Post false, misleading, or fraudulent information.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Scrape, harvest, or collect user data without authorization.
• Introduce malware, viruses, or other harmful code.
• Circumvent or attempt to circumvent any access controls or security measures.
• Use the Platform for any purpose that violates applicable federal, state, or local law.

7. Content Standards

Providers may upload photographs depicting lingerie, swimwear, and tasteful topless content, subject to administrative approval. All such content must comply with the following standards: (a) all depicted individuals must be at least 18 years of age; (b) no explicit sexual acts, genitalia, or fully nude depictions below the waist are permitted; (c) content must not be deceptive, misleading, or violate the rights of any third party; and (d) content must comply with our Acceptable Use Policy.

8. Age Verification

Providers are required to complete age and identity verification before accessing certain Platform features. Verification requires submission of a government-issued photo identification document and a verification selfie. Verification materials are stored securely and are not displayed publicly. We reserve the right to require re-verification at any time. Providing false or fraudulent verification materials is a material breach of these Terms and may result in immediate account termination and referral to law enforcement.

9. Intellectual Property

By uploading content to the Platform, you grant Velvet Lobby a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute your content solely for the purpose of operating and promoting the Platform. You retain all ownership rights in your content. You represent and warrant that you own or have the necessary rights to grant this license, and that your content does not infringe the intellectual property rights of any third party.

The Velvet Lobby name, logo, and all Platform design elements are the exclusive property of Velvet Lobby and may not be used without our prior written consent.

10. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE PLATFORM.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VELVET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Velvet Lobby and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another.

14. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification to your registered email address. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
